Sample Real Estate Forms

The sample forms here are for reference and educational purposes only.  The use of these forms does not constitute legal representation or legal advice by our office.  If you are uncertain about the purpose or of any of these forms you should consult qualified legal counsel.

Offer to Purchase Real Estate

This form is used to make a written offer to purchase real estate.  To be enforceable any offer to purchase real estate must be in writing and signed by both buyer and seller.

​

Amendment to Offer to Purchase

This amendment can be used to change or amend the terms of the Offer to Purchase after it has been accepted by both parties.  This form can be used without creating a counter offer.

​

Basic Buyer Addendum

This form is used when additional terms to the Purchase and Sale agreement are desired.  The addendum is not required but in some instances it can be used to afford additional clarification of the initial terms.

​

Amendment to Purchase and Sale Agreement

Use this form to change or amend terms of the Purchase and Sale agreement after it has been signed.  This form can be used to add or remove a buyer or seller’s name, or correct an error, or revise a term of the agreement.  This form would not be used to change or extend the closing date or other commitment date.  It could be used to change the purchase price or the amount of a deposit.

Personal Property Agreement

This agreement can be used when the seller has agreed to include personal property as part of the sale and the personal property is not listed in the body of the Purchase and Sale agreement.

​

Repair Agreement

This agreement can be used when the seller has agreed to perform work on the property prior to closing.  Use this form if a home inspection reveals defects with the property and the seller agrees to correct or repair the defects.

​

Agreement to Extend Contract Signing Date

This form can be used to request an extension for the date for the parties to sign Purchase and Sale agreement.  In the event the parties are unable or unwilling to sign the Purchase and Sale agreement as agreed upon in the Offer to Purchase, this form provides a written agreement to the extension.

Agreement to Extend Date of Home Inspection

Use this agreement to extend the home inspection contingency date from the current agreed upon date to a new date.

​

Agreement to Extend Mortgage Commitment Date

Use this agreement to extend the mortgage financing date from the current agreed upon date to a new date.

​

Agreement to Extend Date of Closing

Use this agreement to extend the date of the closing from the current agreed upon date to a new date.

​

Multi Use Extension Request

This fill-in-the-blank form can be used to change or extend inspection, signing, financing or other dates contained in a signed real estate contract.

​

Statement of Leases and Rents

Use this form to collect and acknowledge tenant information from the seller on a multi-unit property where the tenant(s) will remain. Obtain a statement for each tenant.

​

Use and Occupancy Agreement - Buyer

Use this form when it is necessary for the buyer to use and/or occupy the property prior to the date of closing.  The form should not be used to create a tenancy agreement between buyer and seller.  This is not a rental agreement.

​

Use and Occupancy Agreement - Seller

Use this form when it is necessary for the seller to use and/or occupy the property after the date of closing.  The form should not be used to create a tenancy agreement between buyer and seller.  This is not a rental agreement.

​

Hold Harmless Agreement

Use this form if the buyer requires access to the property prior to closing in order to perform work or have contractors perform work on behalf of the buyer.  This is not an agreement to occupy the property, but it can be used to allow the buyer to store personal belongings on the property prior to closing.

​

Escrow Agreement

This form is used when it is necessary to hold back all or a portion of the seller’s proceeds in escrow.  Use this form if the seller is willing to close but the seller has not entirely performed under the terms of the purchase and sale contract.  For example if the seller has agreed to make repairs to the property prior to closing but the work has not been complete by the closing date a portion of the seller’s proceeds could be held in escrow at the closing until the work is complete.

Request for Release of Deposit

This form is used when the Buyer has provided a deposit under the terms of an Offer to Purchase or Purchase and Sale agreement and the transaction will not conclude.  Use this form to request that the deposit be release to either the Buyer or Seller.

​

Mobile Home Sale Contract - No Real Estate

This form is used to convey ownership of a mobile home/manufactured home, without real estate, located in Massachusetts, from one party to another by a Bill of Sale.
